1.         PRICE OF SERVICE

Client is informed of the prices for each of the services proposed by Tahiti Nui Helicopters. Prices invoiced to Client include: - costs attached to the helicopter – any taxes connected to the service provided – assistance by passenger handling agents. The prices of the services do not include the pick-up or drop-off of the customers towards the drop zone.

In the case of specific request for the provision of air service (out of price list provided), Tahiti Nui Helicopters will give a quotation covering all requests communicated.

Under pricing conditions:

  • INF (under 2 years): 0%
  • CHD (from 2 to under 12 years): 85%
  • ADT (12 years and over): 100%

 

2.         PAYMENT TERMS

Full payment will be made by Client prior to performance of the service. If payment is made directly to Third party Partners of Tahiti Nui Helicopters (hotels, tour operators and agencies), Client will show a duly completed voucher, indicating the exact description of the service to be provided. If payment is made directly in favor of Tahiti Nui Helicopters, a receipt will be issued to Client.

Regarding payments from Client in favor of Tahiti Nui Helicopters, the following payments are accepted: Bank cards: VISA, MASTERCARD, AMEX, JCB & UNION, wire transfers, Cash payment only in local Polynesian currency XPF (within the limits of the ceilings and conditions defined by the applicable regulations). Tahiti Nui Helicopters undertakes to strictly provide the service stated in the voucher or receipt.

Failure to pay in full for the service booked on the date scheduled for the performance of the service will result in the cancellation by Tahiti Nui Helicopters of the service booked by the client.

 

 

3.         CANCELLATION TERMS

Cancellation by Tahiti Nui Helicopters: the Pilot will be fully responsible for the operation of his helicopter at all times. If the Pilot, at his own discretion, feels that flight safety is compromised (meteorological and/or technical reasons), he may make the decision at any time to end or refuse to commence his flight. Client cannot make Tahiti Nui Helicopters responsible for direct, indirect or induced damage or costs resulting from termination or refusal to operate a flight.

If the number of passengers booked on a shared flight is insufficient, Tahiti Nui Helicopters will propose to Client to postpone the flight.  If postponing the flight is impossible, Client will have full refund of the cost of the service. 

Cancellation by Client: this may generate the following costs:

  • Cancellation > 72H: 10% of service price
  • 72H > Cancellation > 24H: 50% of service price
  • Cancellation < 24H: 100% of service price

However, costs may be cancelled if an expressly contraindicative medical certificate is produced by Client to Tahiti Nui Helicopters.

 

 

4.         MODIFICATIONS

Any modification by Client may generate the costs as follows:

  • Re. private flights: no cost
  • Re. flights said to be shared flights: Modification < 24H: 100% of service price

However, costs may be cancelled if an expressly contraindicative medical certificate is produced by Client to Tahiti Nui Helicopters.

 

 

5.         CONDITIONS OF TRANSPORTATION

Children under 2 do not have individual seat and will sit on a parent’s lap, secured with adjusted safety belt. Children from 2 to 12 are not allowed to sit in the front part of the helicopter or on a seat next to the sliding door. Children in that age category must be imperatively accompanied, on the rear seats, by an adult. Potential risks resulting from vibrations during the helicopter flight are the reason why boarding is refused to pregnant women, unless a medical certificate is provided to this effect. Tahiti Nui Helicopters will not accept liability if a pregnant woman does not declare her condition before boarding.

 

 

6.         REFUSAL AND TRANSPORTATION RESTRICTION

Tahiti Nui Helicopters may refuse to carry a Client if one or more of the following cases occurs or is likely to occur: 

  • Client failed to comply with applicable laws.
  • Carrying Client may jeopardize the safety, health, comfort or convenience of other Clients or the crew, particularly if Client uses intimidation, has an abusive or insulting behavior or language.
  • Client’s physical or mental state, including a state induced by the consumption of alcohol or drugs or medicine, could present a danger, even a risk for himself, other Clients, the crew or property.
  • Client has compromised the safety, good order and/or discipline during the flight.
  • Failure to pay in full for the service booked on the date scheduled for the performance of the service

The voucher and/or the receipt shown by Client:

  • was acquired fraudulently
  • was listed as document lost or stolen
  • was falsified or forged.

 

7.         ON-BOARD BEHAVIOR

Tahiti Nui Helicopters reserves the right to reasonably assess the behavior of a Client on board and, depending on the situation, appreciate whether or not it is likely to disturb, threat, endanger one or more persons, property or the helicopter.

On board the helicopter, as a result of using alcohol, drugs or any other substance, a Client must not behave in a way that will disturb, trouble, threat or endanger one or more persons, property or the helicopter.

Use of tobacco on board the helicopter is strictly prohibited.

If a Client behaves as described above, Tahiti Nui Helicopters may have to take measures it will consider appropriate and reasonably necessary in such circumstances, to stop such a behavior. To that end, Tahiti Nui Helicopters may have recourse to coercive measures and/or disembarking Client at any time in the flight.

If Client fails to comply with the provisions of this article or commits an offence or wrongdoing on board the helicopter, Tahiti Nui Helicopters reserves the right to sue that Client.

 

8.         BAGGAGE

8.1        Baggage allowance

  • With respect to tours:
  • Only carry-on baggage is allowed in cabins (max. 6 kg/passenger)
  • With respect to transfers:
  • Cabin baggage: max. 6 kg/passenger
  • Hold baggage: One 23-kg piece/passenger, the sum of length + width + height not to exceed 158 cm. If excess baggage, please consult us for feasibility).

 

8.2       Prohibited items

            Client must not include the following in his baggage:

  • Items likely to be a hazard to the helicopter, passengers or property on board, as specified in the Regulations on Hazardous Materials issued by the International Civil Aviation Organization (ICAO) and the International Air Transportation Association (IATA), explosives, pressurized gas, oxidizing, radioactive or magnetized substances, flammable substances, toxic or corrosive substances, liquid substances of any type (excepting liquids carried in baggage for Client’s personal use).
  • Items with weight, size, unpleasant odor, configuration or nature, fragile or perishable, which Tahiti Nui Helicopters reasonably considers to be unfit for transportation.
  • Firearms and ammunition other than those intended for hunting or sports purposes, unless they are unloaded, appropriately packaged and with safety catch on. Carrying ammunition is subject to ICAO and IATA Regulations on Hazardous Materials.
  • Edged weapons, thrust weapons, spray cans which may be used as weapons of attack or defense.

 

Tahiti Nui Helicopters is entitled to exempt itself from liability when damage results from the nature or inherent defect of a piece of baggage.

Tahiti Nui Helicopters may, for safety reasons and/or security, refuse to carry the items listed in this article as baggage, or refuse to continue carrying them, if they are discovered in the course of the trip.

For safety/security reasons, Tahiti Nui Helicopters may ask Client to accept, regarding him and/or his baggage, a search or any check.

 

9.         TRANSPORTATION OF PETS

The transportation of pets is subject to Tahiti Nui Helicopters’ explicit acceptance. Tahiti Nui Helicopters may accept to carry Client pets, in the conditions as follows:

  • Dogs, cats, birds and other pets must be conveniently placed in a clear-view container and accompanied with valid documents, such as health and vaccination certificates
  • Tahiti Nui Helicopters will not assume any liability with respect to injuries, diseases or death of pets carried, unless Tahiti Nui Helicopters’ fault or negligence is the cause of the above.

 

 

10.       FORCE MAJEUR

Tahiti Nui Helicopters shall not be deemed to have breached any of its obligations under these terms and conditions and shall not be liable for any delay, cancellation or damage resulting from force majeure. Force majeure is the occurrence of circumstances beyond the control of Tahiti Nui Helicopters, which are abnormal, unforeseeable, and the consequences of which could not have been avoided despite all diligence on the part of Tahiti Nui Helicopters. However, if a trip is interrupted prior to its destination, in whole or in part, due to such causes, Tahiti Nui Helicopters will reimburse the customer for all payments previously received for the completion of the trip.

 

 

11.       LOSS OF PROPERTY OR DAMAGE

Tahiti Nui Helicopters’ liability with respect to the loss of property or damage caused to property (including, without limitation, baggage and personal effects) is limited to $1,000 per Client.

 

 

12.       EXCLUSION OF LIABILITY – GUARANTEE CLAUSE

Tahiti Nui Helicopters’ liability is excluded except in the case of gross negligence. Tahiti Nui Helicopters will in no case accept consequential or induced damage, costs or liabilities, including attorney’s fees, and the uninsured liabilities of Tahiti Nui Helicopters, whether contractual or a result of unlawful acts, shall in no case exceed the amount paid by Client for the service requested. Client must release and hold harmless Tahiti Nui Helicopters for all losses, damage or expenses incurred by Tahiti Nui Helicopters as a result of acts or omissions of Client, his employees, agents and guests.

Moreover, Client undertakes to pay for any and all damage caused to the charter helicopter by him, his employees or guests, excluding normal wear and tear. The same rules of exclusion, liability and guarantee will apply to the owner and operator of the chartered helicopter.

 

 

13.       MISCELLANEOUS

The unlawful or invalid nature of a paragraph, clause or provision of these general terms will not affect or invalidate the other paragraphs or provisions.

Tahiti Nui Helicopters reserves the right to change its General Terms of sale and transportation without notice.

 

 

14.       APPLICABLE LAW

These general terms and the confirmation they are appended to, are governed by the laws in force in French Polynesia. Any dispute resulting from the said general terms or related thereto will be submitted to the jurisdiction of the Courts of law of Papeete-Tahiti, French Polynesia.

 

 

15.       PERSONAL DATA

Client communicates personal data to Tahiti Nui Helicopters for booking, benefiting from ancillary services as well as supplementary services. For this purpose, Client authorizes Tahiti Nui Helicopters to keep the data collected and pass them on to its service providers, government departments, regardless of the country and subject to the applicable law. Client concerned has a right of access to and correction of the personal details thus collected, kept then transferred, insofar as they would prove incorrect or incomplete.

 

16.       CLAIMS

17.       REFUND

Refund terms are as follows:

  • No refund in case of No show
  • In all the other cases specified in paragraph 3, Tahiti Nui Helicopters will refund the service provided within 10 days maximum of receipt of the bank account details provided by Client.

 

**As a result of your act of purchase, you acknowledge that you have read and agreed unreservedly to these general terms. This acceptance will not be questioned subsequently**
